1. Acceptance of Terms

By using GemScan Pro's website, mobile application, or any of our services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Description of Services

GemScan Pro provides professional gemological analysis services including:

• AI-powered gemstone identification and classification
• Specific gravity (SG) calculation and analysis
• Refractive index (RI) measurement
• Scratch detection and surface quality assessment
• Gemstone database access with 500+ entries
• Professional certification and reporting services

Our AI analysis provides preliminary identifications. For legal or high-value transactions, we recommend obtaining professional certified laboratory reports.

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities under your account. Notify us immediately of any unauthorized access.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Gemstone Analysis Disclaimer

• Analysis accuracy may vary based on image quality and lighting conditions
• We cannot guarantee 100% identification accuracy for all gemstones
• Color analysis depends on proper camera calibration
• Scratch detection requires appropriate magnification settings
• Our services are not a substitute for professional gemological certification

5. User Responsibilities

When using our Services, you agree to:

• Provide accurate information and genuine gemstone samples
• Not use our Services for fraudulent or deceptive purposes
• Not upload images that are copyrighted or owned by others without permission
• Not attempt to reverse engineer our AI algorithms
• Not use automated bots or scripts to access our Services
• Comply with all applicable laws and regulations

6. Intellectual Property Rights

6.1 Our Content

All content on GemScan Pro, including text, graphics, logos, images, software, and AI algorithms, is the property of GemScan Pro or its licensors and is protected by copyright and intellectual property laws.

6.2 User Content

By uploading gemstone images or data, you grant us a non-exclusive, royalty-free license to use, analyze, and store this content to provide our Services. You retain ownership of your original images.

6.3 Prohibited Uses

You may not copy, modify, distribute, sell, or lease any part of our Services without express written permission.

7. Payment and Fees

Basic gemstone analysis features are provided free of charge. Premium services including:

• Certified gemological reports ($25+)
• Professional consultation services ($50/hour)
• Bulk analysis packages (custom pricing)

All fees are quoted in USD or Sri Lankan Rupees. Payments are processed securely through third-party payment processors.

8. Refund and Cancellation Policy

• Free Services: No refunds applicable for free features
• Digital Reports: No refunds once analysis report is delivered
• Consultation Services: Full refund if canceled 24+ hours before appointment
• Subscription Services: Prorated refunds available within 14 days of billing

9. Limitation of Liability

To the maximum extent permitted by law, GemScan Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use our Services
• Reliance on gemstone identification results
• Financial losses from gemstone transactions based on our analysis
• Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid us, if any, during the preceding 12 months.

10. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless GemScan Pro, its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of our Services or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sri Lanka.

13. Dispute Resolution

Before filing a claim against GemScan Pro, you agree to attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved within 30 days, either party may initiate formal proceedings.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the effective date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
